Care must be taken in representing purchasers of real estate - identified as one-to-four dwelling units - where
(1) a Notice of Default has actually recorded,
(2) the seller still occupies the dwelling as his / her primary residence, and
(3) the purchaser is an investor - that is, does NOT intend to occupy the property as his / her / its primary residence.
'Foreclosure consultants' do not include attorneys rendering service as an attorney as set forth in Civil Code Section 2495.1
(b) A
foreclosure consultant does not include any of the following:
(1) A person licensed to practice law in this state when the person renders service in the course of his or her practice as an attorney at law.
Consequently, I am available to be hired by investor buyers to assist in the acquisition of dwellings (one-to-four units). Acting exclusively in my attorney capacity, I work pursuant to a written fee agreement and I am compensated on an hourly and/or an incentive-oriented basis.
With listing agents who don't really understand how best to negotiate with lenders, and who are precluded from rendering legal advice, it makes maximum sense to bring me on board as part of the real estate team.
