California Civil Code Section 2945, which regulates "foreclosure consultants", forbids anyone who falls under the definition of a “foreclosure consultant”, as well as a real estate licensee, from collecting any advance fees for these types of services if a Notice of Default has been recorded against your property.
'Foreclosure consultants' do not include attorneys rendering service as an attorney as set forth in Civil Code Section 2495.1
(b) A foreclosure consultant does not include any of the following:
(1) A person licensed to practice law in this state when the person renders service in the course of his or her practice as an attorney at law.

As an attorney licensed in California and Colorado and as a real estate broker, I bring a quality of depth to my 2-Phase representation. In short, Phase 1 i gain a necessary baseline understanding of a client's file – my low fee is fully earned and non-refundable. Phase 2 involves me an exit strategy (i.e., loan modication or short sale) – those fees revolve on the type of representation provided and a refundable retainer is required if the property is short sold.
